I always like to leave a safe distance between myself and the next vehicle, especially when the roads are icy. Some a-hole always wants to jump in there and I always have to make sure I don't hit them.

I would suggest that this is an illegal lane change but unless the accident was on the angle or one side of the vehicle it would be very hard to prove. If it was mid-lange change vs. a complete lane change then it would be clear but a straight rear ender it would be tough.
