Why would they use the name Deadpool at all? Only the somewhat serious fans will know who he is, so only they will want to see him. His character is most certainly not essential to the story of Wolverine.
So if you're going to put him in the film and change his character that much, why not just use a different name or a different character all together. That way you don't risk alienating the fans. There are a ton of characters in the marvel universe who could have filled the role that Deadpool does in this film. Makes no sense to me. Maybe the trademarks were bought as a packaged deal from Marvel?

This is a Marvel Films film, so it didn't need to purchase rights.
Deadpool as apparently been left open to creating it's own spin-off film, BUT in this film he is pretty much terrible.

It's not that they're not following the source material word for word. I loved Transformers from the 80s and early 90s (Gen 2), but also loved the new movie, despite the "OMG PRIME HAZ FLAMEZ" arguement.
This... this is taking the source material, ****ing on it, putting it through a shredder, then re-assembling it. It's not that they didn't go word for word, it's that they took a character, with one of the biggest cult followings in the Marvel universe, and deleted him other than the name. Now all the schmucks who see this film will think that this: *SPOILERS*
