			^^^The difference is the fact that smoking directly impacts people around you negatively. You make the decision to smoke - it hurts me. 
 The other scenarios you outline above require two things to happen.
 
 1. I drink
 2. I drive or I get in a fight or whatever
 
 There is not direct consequence from the alcohol itself.
 
 So I don't think its a double standard though I would agree that stiffer DUI penalties would be great.
