quite honestly, the factors involved are so complex, including genetic, that it's a wash.

yes, the same BAC affects different people differently.

yes, many experienced drinkers aren't that bad at driving with a few too many in them.

that's why it's as low as it is, because the margin of error means lives lost.

that guy at the office christmas party that never ever drinks, but has 3, is WAY more dangerous than the guy that smokes back 8 pints a night and drives every time.

office party guy doesn't know how his reactions change, and is unaware of how unaware he is.

i think the largest 'danger factor' in drunk driving is experience.

personally, i think all impaired driving should be punished - including celphone use and eating, etc.
