Here's a story that has a lot more details. He was turned over to immigration, and immigration ruled that he should be kept in custody, but another immigration official released him. It sounds to me a lot like one individual's error, rather than something systemic in the justice system. As well, it seems that he's been cooperating with the police and immigration officials since his release.

The one who decides the release of detained people under the Immigration and Refugee Protection Act is a Board member, in this case one that works for the Immigration Division. ( I incorrectly stated in my first post that he was a member of the IRB which is incorrect). They are not really officials of iimigration, they are more like judges.
Maybe it was a mistake but non the less, if it was that is a pretty big mistake.
