I'll try to illustrate my point a little more clearly.
Let's say a couple ball teams get together and decide to play baseball. The field is 5 minutes down the road, but there's a big old dog park right across the street. There are no dogs around, so what's the harm? Nothing! No harm at all. The park isn't in use by dogs, so play ball! They play the game, have a great old time, and during the 7th inning stretch the short-stop takes a dump over by third base. They finish up the game, gather up all the stuff and go home.
Would this bother dog owners who use the park? I'll bet it would, but why? They weren't using the park when the ball game was going on.
