That's exactly what I'm thinking.

The Nolan Batman movies seem based on Batman v. Organizations, namely the Mobs and the League of Shadows. Scarecrow and Joker were simply agents working for these organizations. A new sophisticated villain would work wonders... no, not the sideshow freak Penguin... the elegant gentleman Penguin gangster of the animated series/comics would do well here. Especially seeing as Batman is considered a villain now. The Penguin is the perfect villain to start the movie... a Dapper Don type mobster who appears to be cleaning up the streets and going legit vs. a Batman who is considered to be a ruthless, unpredictable vigilante. Rupert Thorne works too... then bring in someone else to be his vicious right hand.

The Riddler is too similar to the Joker to follow up, even if he's not Jim Carrey style. Both are intelligent psychotics that enjoy puzzles and ethical dilemma. Catwoman would be good too, but not the right fit yet, especially since Catwoman + Penguin will make people think Batman Returns remake too much. Zsasz, Bane and Killer Croc (as simply a huge bald guy with sharpened teeth and bad skin) would make good villains too.
