The latter sounds all fine and dandy, however the ultimate evil of allowing this in Canada to settle even family law disputes is that ultimately muslim women end up getting mistreated. This is why feminists argue against this. In muslim communities in Canada often the only people a woman knows is her family and other members of the Muslim community. Should she not want to participate in a Sharia-based arbitration, she could end up being shunned by her family, her friends, and her mosque. So when both parties consent there's a hidden motivation for the woman to consent to a Sharia-based tribunal even if she wished to be in front of Canadian courts.
