Today Associate Chief Justice Wittmann handed down his decision in the trial challenging the Minor Injury Regulation. Justice Wittman has determined the $4,000 cap on minor injury awards is discriminatory and therefore contrary to the Canadian Charter of Rights and Freedoms.
