If someone's going to be doing something like getting highly illegal porn, how dumb do they have to be to download and share it on a p2p network???
They can tell who's uploading and downloading easily.. It's probably a matter of resources though, why go after one guy who's downloading it when they can target the people who make and widely distribute it. Probably more effective at cutting it off at the source.
