Just curious -- if a rental unit is illegal to rent, would tenant laws (including the 90 day notice requirement) even be applicable?

IMO your landlord is giving you the bum steer because most people hate Oilers fans that pretend to be Flames fans especially when the Oilers fan does it on their property.

i am with pepsifree. landlord has right to do what she wants in the common area, shared room style accommodations means that your private space is only the room, similar to a condo where you rent/own a unit and common areas are shared.

They 'can' enter without notice (i.e. they are physically able to do it), it's a matter of if they 'should'. They probably shouldn't.

I'm not so sure in this case though.

If I own a 4plex I can enter the common areas, the areas that the tenants share (laundry room, hallways, etc), without notice.

If I own a single family dwelling, I have to give notice that complies with the RTA. There's no common area at all since there's only one tenant.

In a rooming house, each tenant has a key to their own room. So would the laundry room, hallways, kitchen, living room be seen as a common area (area that the tenants share)? If so then the landlord can enter that part without notice I'd think.

If you are not going to get your damage deposit back, you should fat bomb the place before you leave.

Ok, probably not good advice, but I am a vindictive prick.

I had a landlord try to stiff me on returning a damage deposit before. There was actually no controversy, he just ignored my phone calls probably hoping I would let it go. Fortunately, my wife has a lawyer in her family and he wrote a letter on his office letterhead for free and it was enough to scare him into giving our deposit back. In reality though, we never really would have followed through with legal action.

The guy was a real piece of work though. He had a police officer style hat that he would wear at night while walking his mastiff. He would go around the neighbourhood acting like some community law enforcement agent interrogating teenagers and young adults, when really he was just a guy with a hat he bought from Value Village, but I digress.

You do realize that this is what they may do to you at the RTDES hearing, right? I'm not going to comment about Pepsi's intention, but I would hope you re-read the thread and view it in a new light and consider organizing your paperwork when you go to the RTDES.

When dealing with some of these situations. If you have all your paperwork, neat and tidy. It's easy for the other side to give you some good will if you're polite and organized. If you're adding to the mess of a situation, it'll take forever and you might not get the result you want. I'm always a fan of making a summary and labeling my info. Makes it easy to pull out the necessary information if needed quickly and promptly. This can include emails (ie: Other tenants), signed agreements etc.

Put it this way. If you sit down, be polite, don't engage the landlord if they're being boorish and you might get the mediator on your side. As others have said, you might have to take the loss as a tuition fee in life. Be ready to accept that.

Not to mention, you should be 100% sure that you are understanding the law and how it (not you) defines what it does/covers. If you are basing your entire case off a misinterpretation or misunderstanding (or multiple compounding ones...) of the law, it's going to go very poorly for you.

Don't beat yourself up over this. I think a lot of us have been in similar situations. Others may have been lucky to have good mentor roommates.

Life is all about learning lessons. Just because something is going wrong, doesn't necessarily mean that you did something wrong.
