My car got hail damaged and written off. The report by JD power that sent comparables used two cars that were not comparable to mine (not fully loaded, no rear view camera or navi or paddle shifters). One was from Alberta and one was from BC. Are BC comparables typically used for Alberta?
Problem is there aren't many of my vehicles for sale in Alberta that are comparable. Literally only a half dozen or less and only two are only like mine. I tried using those ones and I was told they wouldn't work.
what are my rights in this position? I'm overseas and all my contact has been through email and it takes her two weeks to reply to me. I wouldn't mind this going to court if that's an option as they low balled me big time and she doesn't seem interested in negotiating.
She's asking me to give her comparables when JD power can't even find me one. What should I do in this position? Because it's making me want to create a few fake ads because I have no other option it seems.
Most companies aren't as bad as people think, just put yourself in their shoes. They want to pay you out but need a paper trail, try http://www.vmrcanada.com/ and see what comes up. The only thing I find unfair with most companies is how quickly they want you out of the rental when negotiating even when you have the coverage.
Also you can hire your own vehicle appraiser. Appraisers are incredibly busy and don't always have the time to investigate as much as they would like, I'm not sure the reasoning they didn't accept your comparables but I'm curious. Most auto adjusters are new and don't really know much more than you, it's a high turn around position.
On the other end of the spectrum it is a vehicle that loses value fast, not every dollar you put into it will or should be accounted for. What kind of vehicle is it and how many km's etc?
If there are 2 cars like yours in Alberta, then what is her argument for why they won't work? Is it a legitimate argument, or is she unwilling to use them because they are too high?
If you feel she is being unreasonable, then tell her that you already found two comparables and feel that they are the the closest you can find in Alberta.
So long as you are being reasonable, I would stick to your guns. They have to settle with you eventually.
Also, your thread title is basically non-sensical. If I were her, I'd lowball you for your inability to write a clear and concise title.

If the amount of damage to your vehicle is being disputed, or other disagreements arise over your vehicle’s repair, and all attempts to negotiate have failed, a formal arbitration process is open to you.
If you choose to follow this procedure, you will be responsible for your share of the cost involved.
To start the appraisal procedure, submit a proof of loss claim form available from your insurer and send a written request to your insurance company
A three-member group will resolve the dispute.
You choose an appraiser, your insurance company chooses one, and the two appraisers appoint an umpire.
An appraiser can be anyone either party considers to be qualified to present its side of the dispute.
Each side pays for its own appraiser and half the cost of the umpire.
The decision of any two of these three people is binding.

I checked the date on this thread 3 times because of the deja vu it was giving me. Wtf. Did you do this exact same thing last year or are you still fighting with the same insurance company over the same super special vehicle to which no other vehicles could possibly compare?
