I don't understand why he would agree to this.

Unless there is a difference between an injured player and a player with history of injury.

He is under 26, so his buyout is 1/3rd.

Well injured players can't be bought out without consent.

The whole situation is confusing.

Despres hasn't played for a very long time and didn't seem close to returning in the playoffs.

If he is genuinely healthy, then he can be bought out.

But if he is still suffering from concussion issues, he would need to consent.

hmmm... so the NHL and NHLPA did some behind the back "shenanigans" to make this buyout legal. While there seems to be some extenuating circumstances involved, this won't help the conspiracy theories that the NHL helps certain teams out of cap troubles

The union has apparently signed off on it, with NHLPA spokesman Jonathan Weatherdon saying, “The NHLPA is engaged in settlement discussions with the NHL regarding Simon Despres contract and the parties hope to have this matter resolved soon.”

"Don't sue us for clearing you to play when you were obviously dealing with a significant neurological injury. If you agree not to sue, we will pay you out the entirety of your contract off the books and pay for your treatment in hopes you can play again. Hopefully we are then off the hook for contributing to what would otherwise be a career ending injury at 25 years old due to our reckless and criminally negligible conduct."
