I can see where Mr Mottle is coming from, but to spread it around like that.... he deserves the lawsuit coming at him. Did he think spreading it around would help him get this issue solved quicker?
I can tell you one thing, demanding that something be done immediately and spreading slander about the company will not help you one bit.

If Cedarglen were thinking, they wouldn't have fixed the problem and just denied the whole thing. They pretty much plead guilty.
Frankly, both sides were both jerks here. I don't feel sorry for either one.

Truth is a defense to defamation, so as long as what he was saying is true, he doesn't have much to worry about.

I got screwed royally by Union Square Condo development/Apex Land Corp. They then accidently forwarded me their entire customer database with the full personal information of all of their clients - it took SO much self restraint to not screw them over in return....

Lawsuit for what?
Email is not private communication.
He did not slander Cedarglen.
I'd have fun hitting the "Forward" button if I caught someone with their head up their ass like that too.

You have a lot more self restraint than I do. If someone blatantly screws me I will go to the other end of earth to get my comeeuppance, and to have it handed to me on a platter would be too much.

The Alberta Infomation Police (which actually exist by another name) would be all over me if anyone complained...
I could tell people like in this thread that they were negligent with their clients personal info but i could never divulge any of that actual personal info without breaking the law.

I don't see anything the guy did that is actionable . . . . its laughable that Cedarglen would think of suing him.
Given the volume of construction these days, the shortage of qualified trades people and the fact that every return visit to a site lowers the profit margin for a company . . . . then this kind of dispute is probably very common right now.
Amusingly, in a similar vein, at the Millarville Market corner a few weekends ago, there was a gigantic, hand-written sign on plywood saying: "Any victims of A-Men Siding and Roofing please phone . . . ." When I came back a few hours later, the sign was gone.

I've heard stories of some people levying 5% holdbacks on their builders. Is this really possible?
If I were Cedarglen, I wouldn't even dream of any lawsuit against him. They need to make this go away quickly, and fade from the public limelight. Suck it up and move on. Going after Jeff just keeps it in the limelight.

The hold back is not legal in Alberta. However in many provinces, it is a standard practice.

Very true. Just shut up, fix this guy's house, and make sure your customer service is exemplary for at least the next 6 months - year. This is one of the exceptions to the anypress is good press rules.
Funny that it's not such an inflammatory statement. It just illustrates that this guy doesn't get it. If he's not the owner, I wouldn't be overly surprised if he gets canned.

Actually this has gotten way out of hand.
My wife works for Cedarglen but was not involevd in this in any way.
However some other people who have had no control at Cedar glen have gotten some real nasty e-mails and phone calls simply because they work there.
Being called a slut should not be part of your job description.
Some putz who works at Anadarko will be visited real soon by the CP.
Yes the president was an idiot for saying things like that but the repercussions are starting to overwhelm the incident.
Personal attacks such as that mentioned above are way out of line.

I knew some good people here at Arthur Andersen Calgary that paid the price for deceit at the executive level of their firm down in Houston. Unfortunately, that's just what happens when it's the top dog in trouble, the innocent people beneath them get hurt when the company craters.
For sure, no one deserves to be called a slut due to the actions of their President. I worked my university summers in an Accounts Payable department so I've been called a whole lot worse...
I wouldn't say the repercussion are starting to overwhelm the incident. The President of a customer service oriented company made fun of a customer, and said words that threw the reputation of the company out the window, potentialy damaging future sales for the company. That's the ugly truth of the "incident", it's not just an e-mail that was inadvertently sent out.
Betcha a name change for Cedarglen is in comingforth.....

Heh heh.
My former manager bought a house from Cedarglen. It wasn't level. He didn't notice until he moved in. He phoned them every day for ages, and I don't think Cedarglen ever did anything about it.

This thread makes me wonder, are there any other developers out there we should stay away from? Any other horror stories? Good stories?
I recently bought a condo from Batistella and after reading all of this, I'm a little nervous/paranoid. I'd like to think I did my due dilligence, but still...

It's pretty damn clear that the people in charge of Cedarglen are complete ######s.
Their president fudgeed up, and rather than try to make amends, they are trying the Microsoft "sue em and hope they cant fight back" strategy.
Ironically, their arrogant attempt at snuffing out this controversy is only making things worse, and with luck, the company will lose millions in sales as a reasult.
While it will be quite some time before I am ready to build a house, Cedarglen just made my "permanent boycot" list. I suspect a great many more Calgarians will do the same. Unfortunately, Cedarglen still has thousands of people moving into Calgary every year to prey on.
