I am looking for some advice, including referrals to lawyers in town, regarding a helluva lemon that we bought my wife to drive our three kids around in...
We have a new Infiniti JX35 / QX60 SUV that has been in the shop 8+ times in the first 10 months of ownership for:
- new transmission
- new steering rack
- new front end
- new tail gate
- Undiagnosed coolant leak
I have been in contact numerous times with the dealer and then Infiniti Corporate, but they have not offered much other than several hundred dollars in 'service credit' I can use at the dealer (that I won't go to after this much trouble)
I have purchased a domain:
www.InfinitiLemon.com to start detailing the issues in more detail (right now it's just a bare bones framework that I need to flesh out) to warn others.
But as another (perhaps more adult) avenue, I am looking for legal options to have Infiniti unwind the lease and take back the car. It's blown up every time we go to our place out in BC, so we literally can't even use it for family road trips, as it was intended, as my wife is certain it will break (as it has done every single time we've left the city).
The SUV has all of 10,000KM on it.
Of course when you google this sort of problem, you get all the (ir)relevant results on US Lemon Laws, which protect consumers from the exact situation we find ourselves. However here in Canada we are SOL when a manufacture sells you a $60,000 lemon.
Is this something that can be dealt with in Canadian courts (small claims or otherwise) or am I basically SOL? At this point, given the service days I've lost the vehicle for and the inability to drive it for extended periods, I'd argue that the contract has been frustrated and they owe me back my lease payments on it, but I am sure it's much more complex than that, however that's my layman's position.
TL;DR - Any suggestions on dealing with a lemon of a new car, or know a lawyer who can help?
