The driver is 26-year-old Richard Rojas, New York Police Commissioner James O'Neill said. Rojas had been arrested twice on suspicion of driving while intoxicated, O'Neill said.
Police said they don't think Rojas' car was being pursued when it drove up on a sidewalk shortly before noon.
